The public use on private lands bill (H5363) is up for a hearing on Tuesday night (March 28th) in House Judiciary. This would remove the State and municipalities from the definition of private landowners protected from liability for public recreation. The state and municipalities could be sued for any accidents on their property, even in the absence of negligence. The Council strongly opposes this bill. For more information on the bill and how to weigh in, please check out this action alert. For those who can’t weigh in on behalf of their land trusts, writing personal testimony or calling local legislators is still very helpful. Instructions for how to do so are in the action alert.
